When I would just go by this alone, knowing that the card is within warranty I woud just say, use the warranty and return the card to get it fixed by the manufacturer. Yes, you will need to miss it for some time but you will get a good one back that will have the right BIOS and clocks. 
I just decide to flash it myself last night using the BIOS off the other card and for some reason it won't let me. I made a bootable USB and only nvFlash v5.57 comes close to flashing it. Also see the below image to illustrate.
Since you did decide to see if you can't fix it yourself, we do feel like that not much can go wrong and if you can't get it fixed, you can still rely on the warranty and get it replaced. The only thing that is bothering me is the image, as that shows something strange about the current BIOS on the card. As that says that version unavailable and other strange values. So before you try anything you need to first provide us a view on the list of graphics devices.
