This is not an issue isolated to the GeForce 9800 series. My GeForce 9600 GT does the exact same thing. So if I set it to 100%, when the GPU goes over 60°C, it will drop to around 37%, but as the temp continues to rise, it will go up slowly. Fortunately for me, the G94 is a very cool GPU and the temp never gets over 60°C unless I run ATITool artifact scanner or something, so I run a constant 35%.
For me at least, it is an issue with the threshold that triggers the fan to increase in speed. At under 60°C, the fan speed never changes from a constant 35% unless I change it manually. At 61°C the fan speed throttling is triggered, and the driver takes over control. I need to verify this, but if I remember correctly, once the temp drops below 60°C again, the fan can be reconfigured manually.
