In the USA, a gift is not taxable for custom charges. This is for a gift, such as your mother mailing to you a birthday or christmas gift.
But a prize won in a contest is not counted as a gift. A contest prize comes under a diffirent category, and contest prizes are considered part of your income. So you technically would have to pay both custom charges and income taxes. Two seperate taxes. This is the law in the United States. I think it is the same in Canada too.
Since you said that the transportation company requested Corsair to send them information, then if Corsair notifies the transportation company that you received a prize and if the government somehow finds out then you may end up getting a tax bill in the mail for income taxes too. This is in addition to what you will pay for custom charges. I know this is how it works in many countries, and I imagine this is true in Portugal too. And you can not call it a gift, because under the law in most countries a gift and a prize is two seperate categories in the laws. So recheck the laws in Portugal and make sure you research the difference between receiving a gift (which is NOT what you are receiving here), and a prize won in a contest (which is what you are really receiving here). I imagine the custom laws in Portugal, seperate the difference between a prize and a gift, the same as the laws in most other countries do. You don't need to pay custom charges on a gift. But you do have to pay custom charges on a prize. Your not getting a gift, but a prize. You also need to pay income taxes on a prize. So both custom charges + income taxes.
Ironically you may end up paying more in charges and taxes then what you can pay for the item brand new. For example, this Corsair memory sells retail at many locations in the United States for $275. But the suggested retail price that the manufactuer may have stuck on the memory could be $499. You are not charged custom charges or income taxes on the actual street value of an item but on the "suggested retail price". Since the suggested retail price is sometimes double what the item sells for in a store, then if you are charged around half the suggested retail price in custom charges + taxes, then you end up getting charged as much as it would cost to buy it.

They want half the commercial cost of it! For taxes, plus a bureaucracy service!
Anyway, I wonīt pay for it. Because I donīt have that much money. My parents are the ones who pay my computer stuff and my University education. So I have no money to pay.

A lawyer told me that I only have to pay VAT over the cost, i.e the money I pay for it. However the transporting company and customs, keep saying that I have to pay over the real value. I donīt know who to believe!

well i didint sound that i was rich or anything. but my taxes here for that product would be around 30-35 dollars....at the most.. thats why i said its not much.. since ur geting something that if u want to go and buy it will cost you hundreds......in my case for my twinx1024-xms3200xl i payed 300$ since i didint win.. and that was maybe the weakest spot in my computer i was using a spectek 512mb pc2700 with latencies of 2.5 -3 - 3- 7 and generic.. i must say that my computer got a boost in performance but not something .. in my opinion the performance i got is not paired with the money i payed.. still its a good memory..(i have set the 2-2-2-5 timings in bios mannually) and placed my vdimm volts to 2.8 (as i saw in ramguy support page)

The problem is that I have to pay the tax, around 50 euro, here, 50 euro must be around 66 dolars. This must be the country with the highest VAT, in the world! Itīs 19 %! Plus a bureaucracy (the filling papers service) service. A Service, the company that transports the package from the US, to Portugal, charges to me. And that service charge will allways be the same, and is always superior to 50-60 euros. Unless the declared value of the package is inferior to 22 euro equals 25 dolars! If the declared value is superior to 25 dolars, I still have to pay that service.
As you can see. A prize, that costs me more than 100 euros! The sum of all that.
My lawyer, says that I have to pay VAT tax over the value that I pay for it. That is zero of VAT. And zero of customs tariff. Because electonics products pay 0% of customs tariff.
Why do I have to pay, if I donīt.
palm521, would you pay to someone, knowing that you are being robbed? Consider you donīt have a gun on your head! Well I donīt!
Now, considering that I have to pay taxes over a prize. I donīt know yet if I have or donīt. Than it would be more advantajeous to me, to pay lestīs say, one dolar to Corsair, that way I wouldnīt have to pay that service, the company, wantīs so much and any type of tax.

Today, I contacted a lawyer of the Portuguese Consumer Association. I exposed the problem. She will revise the law and contact me tomorrow! I told her all the truth. Like I did, from the beginning to everybody. I donīt like liers, so I am not one!
If I want to go with this to the court of the law. Acording to the law, I can get one for free! My government pays his royalties. As you can see, my government is very fair.
